Buying California Real Estate as a Foreign Buyer
A practical starting point for international buyers exploring homes, investment property, and financing in Southern California.
Can a foreign buyer own California real estate?
In general, non-U.S. citizens and nonresidents may be able to purchase California real estate, but the path depends on buyer status, the property, the lender, the bank, escrow and title requirements, and the source of funds. A purchase does not by itself provide immigration status.
Plan the purchase before making an offer
International buyers should clarify whether the purchase will be cash or financed, how funds will be transferred, and which identity and source-of-funds documents will be needed. Escrow, title, and the receiving bank may require advance verification. International wires should be planned carefully and confirmed using trusted contact information.
- Cash purchase: prepare proof of funds and allow time for bank and escrow review.
- Financing: availability, documentation, reserves, income verification, and terms vary by lender and buyer profile.
- Ownership: ask qualified title and legal professionals about how title should be held.
- Operating costs: budget for property tax, insurance, HOA charges, repairs, and utilities.
If the property will be rented or resold
Rental rules, management, insurance, local requirements, and tax reporting can affect an investment decision. A future sale may also involve FIRPTA withholding if the seller is treated as a foreign person for U.S. tax purposes. Plan early with a CPA or tax attorney, escrow/title professional, lender, and other appropriate advisors.
